Sec. 5. (a) Except as provided in subsection (b), the state department, a local unit of government (as defined in IC 14-22-31.5-1), the corporation, or a local health department may not impose any rules, regulations, certifications, or licensing requirements on: (1) a homestead vendor; or (2) an owner of a small farm; that are not required under federal law. (b) The state department, a local unit of government (as defined in IC 14-22-31.5-1), the corporation, or a local health department may investigate complaints against: (1) a homestead vendor; or (2) an owner of a small farm; regarding a foodborne illness derived from the homestead vendor or the owner of a small farm's food product.
