Sec. 2. Unless a loan is made subject to this chapter by agreement under section 41 of this chapter, and except with respect to: (1) disclosure (section 14 of this chapter); (2) debtors' remedies (IC 37-2-6-8); (3) providing payoff amounts (section 12 of this chapter); (4) providing property tax information (section 46 of this chapter); (5) powers and functions of the department (IC 37-2-7-3); (6) the department's examination and investigatory authority (IC 37-2-7-5); and (7) the department's administrative enforcement authority (IC 37-2-7-9); the term "consumer loan" does not include a first lien mortgage transaction.
